We are delighted to introduce our new family mediation service, giving separating couples another constructive, flexible and cost-effective way to resolve arrangements for their children and finances.

Meet the mediator

To introduce our new family mediation service, we sat down with Joanne Thomas, our family mediator, to find out more about her experience, her approach to mediation and what clients can expect from the process. Joanne is a solicitor and qualified family mediator and has recently joined Howes Percival as a Partner in the Family Team, bringing with her more than 14 years’ experience in family law.

What is family mediation?

Family mediation gives separating couples the opportunity to work through arrangements for their children and finances with the support of an independent, professionally trained mediator. It can also help families revisit arrangements when circumstances change, particularly as children grow and their needs develop. The process keeps decision-making in the clients’ hands: the mediator will not impose an outcome but will help clients explore options and work towards proposals that are right for them both.

What drew you to family mediation?

During my legal career, I have seen many clients spend eye watering amounts of money on legal fees navigating a court system that is under immense pressure, only to emerge from the process feeling unhappy and unheard. I was drawn to family mediation because it offers separating couples a different way forward; one that gives them greater control and focuses on finding practical solutions that work for their family without spending all their family money on legal fees.

How would you describe your approach?

I bring a calm, measured and practical approach to mediation.  I recognise how daunting it can feel to sit down and talk about deeply personal issues, particularly when emotions are running high.  I aim to put people at ease and give each person the time and space they need to feel heard.  I take a practical, down-to-earth approach, helping clients work through their options without pressure so that the decisions they reach feel right for them and their family.

What is the biggest misconception about mediation?

That you have to like your ex to use mediation!  For many separating couples, the obstacle to mediation is not an unwillingness to find a solution, it is the thought of having yet another conversation that goes round in circles, becomes heated, or leaves one person feeling unheard.

Family mediation is not simply another difficult conversation across the kitchen table.Yes, difficult conversations will need to be had, however, as a mediator I remain impartial and give discussions structure, keep them focused on what happens next and help bring them back on track if old arguments begin to take over.  I am not there to take sides, be judgmental or force either client to accept an outcome.

What do you find most rewarding about the process?

As a mediator, I am in the unique and privileged position of hearing both sides of the story. As with my legal work, the most rewarding aspect is helping people during one of the most vulnerable and difficult periods of their lives.  I am a natural problem-solver and enjoy supporting separating couples to work through issues together and find solutions that are right for them.  Knowing that I have played a part in helping them move forward is rather fulfilling.
