Howes Percival welcomes decision to postpone probate fee hike

Leading regional law firm, Howes Percival has welcomed news that the much debated new Probate fees, which were due to take effect next month, are to be postponed until at least after the general election on 8 June of this year.

The proposed fee changes would have meant some estates paying up to £20,000 to obtain a Grant of Probate, compared to the current charge of £155 where the application is made by a solicitor. The Ministry of Justice has confirmed the Government’s decision not to take this any further forward at this stage is due to the lack of time available to bring the changes into law before Parliament is dissolved ahead of the impending general election.

“Tom Lawrence, Director in the estates team at Howes Percival, comments, “The news will come as welcome relief for many and certainly now removes the recent pressure placed on a number of grieving families to try and obtain Probate more quickly, to secure the current lower application fees. I would expect the outcome of the general election to have a significant bearing as to when the proposals receive attention once again.”
