Leading regional law firm Howes Percival has launched a free, step-by-step guide to help companies manage partnership disputes.
The new guide is part of the firm’s ‘Litigation Maze’ series, designed to ensure organisations stay on the right side of the law and complex issues are handled correctly.
Disputes between business partners can sound the death knell for a company with disagreement over the direction of a business one of the most common causes of conflict between business partners.
The flow-chart format shows, at a glance, the best way to manage the situation without damaging the company or dissolving the partnership, showing the route that companies need to take at any stage of a dispute. The aim is to put them on the right track to manage a resolution in a cost-effective manner – and, if necessary, show them the best time to instruct a lawyer.
Commenting on the launch of the new guide Satnam Chayra, Partner at Howes Percival said, “Business partnerships – like marriages – can run into serious difficulties and, when disagreements arise, emotions can run high. Some of the most difficult partnership disputes are those centred around family businesses, where the added level of personal relationships can lead to deeply hidden issues coming to the surface, making matters harder to resolve.
“When a dispute arises between business partners, its essential to act swiftly to help avoid the partnership, and potentially the business, being irrevocably damaged. Once relationships start to unravel it can be hard to salvage assets if they are not physical, such as reputation and goodwill.
“As with all litigation, each situation will turn on its own facts, and to a lesser degree the personalities involved. While there’s no single answer, our guide aims to give businesses clear direction on the steps they should take. We always encourage parties to a dispute to seek professional help early – in the long-run it costs less to resolve in that way.”
