The Presidents of the Employment Tribunals in England & Wales and Scotland have announced the annual increase to the “Vento Bands”. These are the guidelines which are used by Employment Tribunals when assessing how much compensation to award for “injury to feelings” in discrimination claims. The updated Vento Bands will apply to claims presented on or after 6 April 2026.

These bands are reviewed annually and take into account changes to the Retail Prices Index measure of inflation.
Where any discrimination claim is successful, the Employment Tribunal has discretion to make an award of compensation for injury to feelings. As illustrated by the updated Vento Bands, this can be substantial in serious cases and will be in addition to any award for financial loss suffered. Employers could therefore face significant liabilities. To help minimise exposure, it is key that employers ensure that any policies on equality, diversity & inclusion and anti-harassment & bullying are up to date, and that staff are provided with adequate training which is regularly refreshed.
