Howes Percival’s Dispute Resolution team has successfully secured judgment on behalf of client, Henderson & Jones Limited, following a hard-fought four-day trial in the Business and Property Courts at the Royal Courts of Justice.
The dispute arose following an oral settlement agreement which the defendant attempted to renege on. During the proceedings, the Court considered a range of complex issues, including whether the parties’ conduct established a course of dealing, the construction of oral agreements, whether any misrepresentations had been made, and whether the payment of an invoice amounted to an acceptance of terms.
After reviewing the evidence over the course of the trial, HHJ Gerald ordered judgment of approximately £1,000,000 in favour of Henderson & Jones Limited.
